1. Acceptance of Terms

By downloading and using the NuevaLife mobile application, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app.

2. Medical Disclaimer

NuevaLife provides general wellbeing guidance only. It does not offer medical advice, diagnosis, or treatment.

Information entered into the app — including details about medications, injuries, sleep, women's health, and postpartum recovery — is for personal tracking and general wellness support.

NuevaLife is not a substitute for professional medical care. Always seek the advice of a qualified healthcare provider regarding any medical condition, symptoms, or questions about your health.

Do not disregard professional medical advice or delay seeking it because of information provided by this app.

If you are experiencing an emergency or severe symptoms, contact your local emergency services immediately.

This applies to every health-adjacent feature in the app, including but not limited to Injury Tracking, Medications, Running on Empty, Women's Health, Sleep Tips, and Fitness recommendations. Nothing generated or logged in these features — including AI coach guidance, exercise warnings, symptom tracking, or recommendations you or a third party (trainer, physio, doctor) enter — constitutes medical advice, and NuevaLife holds no responsibility for health outcomes resulting from your use of them.

3. User Account & Responsibilities

3.1 Account Security

You are responsible for maintaining the confidentiality of your account login credentials. You agree not to share your password and to notify us immediately if you suspect unauthorized access.

3.2 User Conduct

You agree not to upload, post, or transmit illegal, defamatory, or harmful content. Engage in harassment, hate speech, or discrimination. Attempt to hack, breach, or interfere with NuevaLife systems. Impersonate another person or organization. Use the app for any unlawful purpose.

3.3 Content Violations

NuevaLife may remove content or suspend/terminate your account if you violate these terms or engage in harmful conduct.

4. Intellectual Property

All content in NuevaLife—including coaching materials, designs, text, graphics, audio, video, source code, and trademarks—are the property of NuevaLife or its licensors. You may not reproduce, distribute, modify, or transmit any content without prior written permission.

Personal data you create (journal entries, mood logs, health data) remain your property, but you grant NuevaLife a license to store, process, and use that data to operate and improve the app.

5. Limitation of Liability

To the maximum extent permitted by law: NuevaLife is provided "as is" without warranties of any kind, express or implied. NuevaLife is not liable for direct, indirect, incidental, special, or consequential damages arising from app use, including health outcomes, injuries, or loss. NuevaLife is not responsible for third-party services (music streaming, payment processors, cloud storage). You assume all risk associated with using the app, including reliance on coaching or wellness advice.

6. Third-Party Services

NuevaLife integrates with external services including Google Cloud Text-to-Speech, ElevenLabs, Spotify, Apple Music, YouTube Music, Amazon Music, Deezer, Tidal, Apple Health, and Google Fit. NuevaLife is not responsible for these services' practices, outages, or data handling. Refer to their privacy policies for details.

7. Payment & Refunds

7.1 Paid Tiers

Where paid memberships are offered, they are non-refundable except where required by law or app store policy. The current iOS and Android apps do not sell memberships.

7.2 Cancellation

You may cancel a subscription at any time. No refunds are issued for partial months.

7.3 Billing

Subscriptions auto-renew until canceled. You are responsible for monitoring your billing.

8. Termination

NuevaLife may suspend or terminate your account if you violate these Terms of Use. Engage in harmful, illegal, or abusive conduct. Violate app store policies. Fail to pay for services (if applicable). Upon termination, your access to NuevaLife ends immediately. Some data may be retained for legal or operational reasons.

9. Changes to Terms & Services

NuevaLife may update these Terms of Use at any time. Continued use of the app constitutes acceptance of updated terms. Material changes will be notified via in-app notice or email.

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of Queensland, Australia.

10.2 Informal Resolution

Before pursuing legal action, contact us to resolve disputes. Email: nuevalife@nuevalifefamily.com. Response time: We aim to respond within 2 business days.

10.3 Limitation

Any legal action must be brought within one year of the dispute arising.

11. Severability

If any portion of these Terms is found unenforceable, the remaining portions remain valid and enforceable.

12. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and NuevaLife regarding use of the app.
